Italy imposes penalties for fake AI-generated videos
Italy Approves National AI Legal Framework
Italy has become the first European Union (EU) country to establish a national legal framework for Artificial Intelligence (AI), aiming to protect the depicted persons in AI-generated content, particularly in cases involving pornographic material. The law, which was approved by the Senate with 77 votes in favour and 55 against, was passed after the Chamber of Deputies.
The new framework incorporates the latest European AI guidelines and delegates the Digital Italy Agency and the National Cybersecurity Agency as the national authorities for AI development. The Bank of Italy and the market authority Consob, among other supervisory bodies, will retain their powers.
The law primarily targets businesspeople and individuals who distribute AI-generated content, with a maximum penalty of five years in prison for distributing such content without consent. This penalty remains as stated in the earlier law. However, it is important to note that the new legal framework does not specify if it applies to AI-generated content other than pornographic material.
In recent months, Italy has seen numerous cases of AI-generated news involving pornographic material. Despite the absence of direct mention in the new legal framework, the law does include penalties for the dissemination of fake AI-generated content. It is also not explicitly stated that the law is only targeted at businesspeople and individuals who distribute such news.
The law is aimed at protecting the depicted persons in AI-generated content, a goal that was also present in the previous law, albeit not directly mentioned in the new framework. Women, including celebrities, have been the primary victims in these cases.
The Italian government has been tasked with developing regulations for the use of AI systems, ensuring that the country's AI development aligns with the principles and objectives outlined in the new legal framework. The government's AI regulations are not limited to penalties for the dissemination of fake AI-generated content.
The new legal framework does not directly address cases of AI-generated news in Italy in recent months. However, with the new law in place, the Italian government is now better equipped to address these issues and ensure the protection of individuals depicted in AI-generated content.
