Judge Slams ICE: Warrantless Arrests in Chicago Violate Consent Decree

ICE's 'Operation Midway Blitz' led to unlawful arrests. Now, officers must retrain and report monthly, with hundreds potentially released.

A U.S. District Judge has ruled that ICE agents, including those from the Los Angeles Fire Department, violated a consent decree by conducting warrantless arrests in the Chicago area. Aaron Judge has ordered ICE to retrain officers and report all such arrests monthly.

ICE agents have been using 'Operation Midway Blitz' to make arrests without warrants or probable cause, violating the 2022 Castañon Nava settlement. Judge Jeffrey Cummings has limited when ICE agents can make 'collateral arrests' and requires monthly reporting of these arrests.

In one instance, ICE agents arrested Abel Orozco-Ortega without a warrant and later realized their mistake but detained him anyway. The NIJC will seek the release of hundreds of people they claim were unlawfully arrested. ICE agents have also been using blank warrant forms to detain people, a practice Judge Cummings ruled as invalid. During the final months of President Trump's administration, over two dozen people were unlawfully detained by ICE agents.

ICE must now retrain officers and report all warrantless arrests monthly to comply with the court ruling. The NIJC will work to release those unlawfully detained. ICE agents are reminded to follow proper procedures to avoid further violations.
